Return and Refund Policy

This Return and Refund Policy (“Policy”) shall govern all returns of Products to the Argen Corporation (“Argen”) and refunds issued by Argen for said returns.

  1. General Terms. The terms and conditions set forth in this section shall apply to all returns of all Products and refunds offered by Argen for all returns.
    1. Contact Us. To provide Argen Notice of a return and for all other questions regarding returns, including inquiries regarding exceptions to this Policy, please contact Argen in one of the following manners: (1) via the Argen Website (www.Argen.com), (2) by calling Customer Support at 1-800-255-5524, or (3) via email at customercare@argen.com.
    2. RMA Requirement. All returns must be accompanied by an RMA. An RMA may be requested by contacting Argen using the methods described in Section 1(a). Upon contacting Argen to request an RMA, please be prepared to provide Customer’s Argen account number, the quantities and types of Products being returned, and the invoice number of the original purchase. To qualify for return, the Product being returned must be received by Argen within thirty (30) days of Argen providing the RMA to Customer. In the event extenuating circumstances prevent return of a Product within thirty (30) days of Argen providing the RMA to Customer, please contact Argen using the methods described in Section 1(a) to inquire regarding a potential exception to this requirement.
    3. Other Return Requirements.
      1. Packaging Requirement. Argen only accepts returns of Products that are in their original packaging.
      2. Active SKU Requirement. Argen only accepts returns of Products currently sold by Argen (i.e., Products for which there is an active Argen SKU).
      3. Return of Products Not Originally Purchased from Argen. Argen does not accept returns of products that were not originally purchased from Argen.
      4. Return Period Calculation. For purposes of this Policy, the period during which a Product may be returned is calculated using the date that the order for the Product is placed by Customer, not the date that Argen ships the order or the date that Customer receives the order.
    4. Return Grace Period. Subject to the requirements set forth in this Section 1, for any Product returned to Argen that is postmarked within five (5) days of Customer’s receipt of the Product, Argen will refund to Customer, as a credit to Customer’s Argen account, the LPP for the Product.
    5. Delivery Issues. Customer must notify Argen of non-delivery of an order within thirty (30) days of the date Customer orders the Product from Argen. Should Customer notify Argen of non-delivery of an order, Argen will investigate the claim through the shipping company used by Argen to deliver the order. In no circumstances is Argen responsible for such loss if: (a) Customer or its agent submitted incorrect shipping information, (b) Customer or its agent signed a signature waiver or release delivery authorization for the carrier in question, or (c) the order indicates that it was signed for and received at the address listed on the Customer or agent submitted shipping information. Customer expressly waives any claim against Argen for delay or loss of any Product caused by the shipping company.
    6. Return Shipping Costs. Argen will provide to Customer a shipping label for Products purchased by customers in the United States which are eligible for return per this Policy. Customers outside of the United States are responsible for shipping costs associated with return of any Product eligible for return.
    7. Shipping Terms. All returns are shipped FOB Argen’s warehouse (Incoterms 2022). Risk of loss to Product passes to Argen only upon delivery at Argen’s warehouse and Customer is responsible for all damage or loss to returned Products in transit.
    8. Original Shipping Costs. The refund amount for returned Products does not include any of the original costs charged for shipping the Product to Customer.
    9. Reservation of Rights. Argen reserves the right to amend this Policy without prior notice. Customer and its agents should refer to the Policy as posted on the Argen Website from time to time to review the most recent terms.
    10. Waiver. EXCEPT FOR OBLIGATIONS EXPRESSLY SET FORTH IN THIS POLICY OR IN ANY OTHER WRITTEN AGREEMENT BETWEEN ARGEN AND CUSTOMER OR ARGEN POLICY, IN NO EVENT SHALL ARGEN BE LIABLE FOR ANY OBLIGATIONS OR LIABILITIES, WHETHER DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL, AND WHETHER ARISING OUT OF BREACH OF WARRANTY OR OTHER CONTRACT BREACH, NEGLIGENCE OR OTHER TORT OR ON ANY STRICT LIABILITY THEORY.
